Terms of sale
Who you are buying from
Phoena Art, a sole trader operating from California, USA. Contact: atelier@phoena.art.
Who can order
You need to be 18 or over to place an order. Buying here means you confirm that you are. The privacy notice says the same, and this is the term that carries it: a contract with someone under 18 is not reliably enforceable, and all sales here are final.
What you are buying
Every listing is a single, physical, original piece, whether that is a work for a wall, an object for a room or a garden, or something made to be carried and used. There is one of each. Copyright in the design stays with the artist: you own the object, not the right to reproduce it commercially. Photographing your own and posting it is welcome.
Colour and detail
Screens vary. Listing photographs are taken in daylight without filters and are as close as a photograph gets, but a handmade object seen in person will differ slightly, and small irregularities are a property of the process rather than a fault. Dimensions and materials listed on each page are accurate.
Availability and holds
Adding a piece to your cart does not reserve it. A piece is held only once you begin checkout, for 30 minutes, and is released automatically if payment is not completed. Because each work is unique, the first completed payment takes it.
Prices and tax
Prices are shown in US dollars and exclude sales tax. Any tax due is calculated at checkout based on your delivery address and is shown before you pay. Import duties on international orders are the buyer’s responsibility and are not collected at checkout.
Payment
Payment is taken by Stripe at the point of order. Your order is confirmed only when Stripe confirms the payment, at which point you receive an email with an order number.
All sales are final
Orders cannot be cancelled, returned, or refunded on the basis of a change of mind. Each piece is unique, is removed from sale the moment it is bought, and is packed and dispatched individually. You are required to acknowledge this before an order can be placed, and that acknowledgement is recorded with the order.
This does not affect a piece that arrives damaged or materially not as described. Raise it within 14 days of delivery with photographs and a refund, partial refund, repair, or replacement is arranged at the artist’s discretion. Nothing in these terms limits any right you have under applicable law that cannot be excluded by agreement. Full detail on the shipping and returns page.
Personalised engraving
Some pieces can be engraved with words you choose. The charge is shown on the listing and again in your cart, before you pay.
Engraving is cut by hand, once. It cannot be undone, altered, or done again, and a piece carrying your words cannot be sold to anyone else. So a personalised piece is final in the fullest sense: please check your spelling before ordering, because it will be engraved exactly as you typed it. If the studio engraves something other than what you submitted, that is the studio’s mistake and will be put right.
Handmade, not machine finished
Every item is made by hand by one person. Small irregularities in seams, edges, glazes, joins, and finish are inherent to that and are not defects. Natural materials vary in grain, tone, and texture, and no two pieces are identical. You are required to acknowledge this before ordering. A piece exhibiting the ordinary characteristics of handmade work is not considered damaged or not as described.
Damage in transit
Everything ships insured. If a piece arrives damaged, photograph the packaging and the work before doing anything else and email the studio within 48 hours. A refund or replacement is arranged from there.
Liability
Nothing in these terms limits liability for death, personal injury, or fraud. Otherwise, liability for any single order is limited to the amount you paid for it.
Governing law
These terms are governed by the law of the State of California, without regard to its conflict of law rules. Any dispute arising from them or from an order placed here is subject to the exclusive jurisdiction of the state and federal courts located in California.
Nothing here removes a right you have under the consumer protection law of the place you live, where that law says it cannot be contracted out of.
